Your POPIA Document Checklist

Follow these steps to work towards POPIA compliance

  • 1

Prepare Your Section 18 Privacy Information

Set out what you collect, why, who it may be shared with and how you protect it. A privacy policy is the usual way to do this

  • 2

    Add Terms of Service (Optional)

Not a POPIA requirement, but useful if you sell or operate online: they set the rules for using your website or service

  • 3

    Make Your Privacy Information Available

Tell people what section 18 requires when you collect their information, for example by linking your privacy policy in your website footer and on forms

  • 4

    Check Your Basis for Processing

Section 11 lists six grounds, including consent, performing a contract and complying with the law. Where consent is the right basis, get it and keep a record

  • 5

    Implement Security Measures

Secure databases, encryption, access controls as stated in your policy

  • 6

    Review & Finalise

Review the documents and tailor to your situation — for businesses handling sensitive data, an attorney review is sensible

POPIA Compliance Questions

Common questions about POPIA and your privacy documents

Who needs to comply with POPIA?

POPIA applies to personal information that a business or organisation records and processes, where the business is based in South Africa or uses means in South Africa to process the information. The Act excludes some processing, such as purely personal or household activity and information that has been de-identified so it can't be re-identified. For most businesses, it covers websites that collect names and emails through contact forms, online shops, customer databases and employee records. If you're not sure whether an exclusion applies to you, check the Act or ask the Information Regulator.

What happens if I'm not POPIA compliant?

The Information Regulator can impose administrative fines of up to R10 million, and some offences under the Act carry a fine or imprisonment of up to 10 years. Beyond the penalties, a data breach or complaint can damage your reputation and customer trust, and some larger organisations ask suppliers how they protect personal information before they sign a contract.

Are these documents enough on their own?

Our AI generates documents drafted using POPIA requirements and South African legal frameworks. They give you a structured starting point to tailor to how your business actually handles personal information. Review before use — depth to match the document. For businesses handling sensitive customer data or complex processing flows, an attorney review before publishing is sensible.

Can I customize the documents for my business?

Yes! Our AI customizes each document based on your specific business information, data collection practices, and industry. You'll answer a detailed questionnaire, and the AI generates a unique document tailored to your needs. If you purchase the "All Formats" option (PDF + Word + Google Docs), you can further edit the documents after generation.

Do I need both Privacy Policy AND Terms of Service?

Not necessarily. POPIA doesn't prescribe a document called a privacy policy, but section 18 requires you to tell people certain things when you collect their personal information, such as what you collect, why, and who it may be shared with. A privacy policy is a common way to do that. Terms of Service are a separate agreement that sets the rules for using your website or service, such as acceptable use, liability limits and how disputes are handled. They aren't a POPIA requirement, but many businesses that sell or operate online use both.

How long does it take to get my POPIA documents in place?

Answering the questions takes about 10-15 minutes, and the documents arrive by email within minutes. Documents are only one part of meeting POPIA's requirements: you also need to put security measures in place, make your privacy information available (usually by publishing your privacy policy), get consent where it's the right basis and make sure your team knows how to handle personal information. Plan time for those steps, and for reviewing the documents, before you rely on them.
